Do I need a lawyer to buy property in Spain?+
Technically no, but practically it is essential. A Spanish property transaction involves legal due diligence (checking for debts, mortgages, urban planning restrictions, community charges), drafting and reviewing the arras contract, and representing you at the notary. Without an independent lawyer reviewing the transaction on your behalf, you take on all these risks personally.
What is an NIE number and how do I get one?+
An NIE (Número de Identificación de Extranjero) is a tax identification number required for virtually all legal and financial transactions in Spain, including property purchases, opening bank accounts and paying taxes. We can apply for it on your behalf with a power of attorney, or guide you through the process at a Spanish consulate or police station.
What taxes are payable when buying property in Spain?+
For a resale property you pay Impuesto de Transmisiones Patrimoniales (ITP) — typically 7–10% depending on the region. For new-build properties, you pay IVA (10%) plus Actos Jurídicos Documentados (AJD, around 1.5%). Additional costs include notary fees, land registry fees, and legal fees. We provide a full cost estimate before any commitment.
What is an arras contract?+
An arras contract is a preliminary purchase agreement that locks in the price and terms. You typically pay 10% of the purchase price as a deposit. If you withdraw, you lose the deposit. If the seller withdraws, they must return double the deposit. It is crucial that this contract is reviewed by your lawyer before you sign.
Can I buy property in Spain without visiting in person?+
Yes. With a notarised power of attorney, we can represent you at every stage — including at the notary for completion. Many of our international clients purchase property in Spain without being physically present.
