Common questions
How long do I have to make a claim after an accident in Spain? +

Time limits vary by type of claim, but traffic accident claims generally must be brought within one year of the accident or of reaching medical stability. Missing this deadline can mean losing the right to claim entirely, so it is worth getting advice as soon as possible after an accident.

What is the baremo and how does it affect my compensation? +

The baremo is Spain's official scale for calculating compensation in traffic accident injuries, covering categories like medical treatment, time off work, permanent after-effects and moral damages. It gives a structured basis for the claim, but the amounts still depend heavily on how the injury and its impact are documented and presented.

The insurance company offered me a settlement. Should I accept it? +

Not before it is reviewed. Initial offers from insurers are often lower than what the baremo and your medical evidence would actually support. Once you accept and sign, it is generally final, so it is worth having the offer checked before you agree to anything.

I was injured at work. Can I claim against my employer? +

It depends on whether the employer failed in a safety obligation. Even where Social Security covers part of the cost through workplace accident benefits, you may have an additional claim against the employer or their insurer if negligence contributed to the accident.

Do I need to go to court to get compensation? +

Not always. Many claims settle directly with the insurer once the claim is properly documented and presented. Court becomes necessary mainly when the insurer disputes liability or offers a settlement that does not reflect the actual injury and losses.
