If someone in your family dies in Spain without a valid will, the law has a set order for who inherits, and nephews are not usually first in line. But there are two situations where a nephew can end up inheriting anyway.
1. When closer relatives have died
If the family members who come before nephews in the order of succession, meaning the spouse, and the direct ascendants and descendants, have already passed away, nephews can move up and inherit.
2. When closer relatives waive their rights
If the relatives who would normally inherit before the nephews choose to renounce the inheritance, the nephews become the beneficiaries instead. In this scenario, the deceased's siblings reject the assets, effectively passing them on to their own children.
