"Intestate" is the legal term used when someone dies in Spain without a valid will, or without a will that holds up legally. In that case, their assets pass to their closest relatives, up to the fourth degree of kinship.
In Spain, working out who the intestate heirs are, when there is no will, falls exclusively to notaries. It's their job to formally declare who is entitled to inherit.
