If you run a business in Spain and want to email or text your customers about offers, new products, or promotions, there are rules you need to follow. Get it wrong and you could be breaking the law, even if your intentions are good.

Spanish law does allow commercial communications by email, SMS, or other electronic means. But the message must clearly show who is sending it, so the recipient always knows which company is behind the ad.

You can only send marketing messages by email to people who have asked for them or given their express permission, or to existing customers you already have a contractual relationship with. In that second case, you can send them ads about products or services similar to what they already bought from you.

You must also always give the recipient a way to opt out of having their data used for marketing. This has to be offered both when you first collect their data and every single time you send them a commercial message.

On top of that, the law requires you to make it simple and free for people to withdraw their consent at any time, and to clearly explain how they can do that.

These same rules apply not just to email, but to other similar electronic messaging, including SMS and other mobile messaging services.
