If the deceased did not leave a will, the heirs must obtain a notarized document called the Declaration of Heirs Ab Intestato. This document, following legal guidelines, defines who the legal heirs are, ensuring that the inheritance is distributed according to the law.
✅ Requirements for a Declaration of Heirs "Ab Intestato"
Identification Documents of the Parties Involved:
- Spanish Citizens: DNI
- Foreign Nationals: NIE with photo, or NIE without photo accompanied by a passport or residence card.

- Original death certificate.

- Birth certificates of the siblings.

- If Married: Original marriage certificate.
- If Widowed: Spouse’s death certificate.
