If you are ever involved in an accident between a car and a pedestrian in Spain, whether as the driver or the pedestrian, who is responsible is not always obvious, and it changes who gets compensated and who may face penalties.
If the pedestrian did everything right, the car's civil liability insurance covers the accident. For example, if someone is crossing on a marked pedestrian crossing and gets hit by a car, that person is covered by the driver's insurance.
But it can work the other way too. If a pedestrian crosses in the middle of the road, deliberately and at a moment that is clearly not the driver's fault, and this can be proven, the pedestrian would not receive compensation and would instead be responsible for the damage caused.
Blame can also be shared between both sides. This happens, for example, when a pedestrian crosses somewhere that is not a proper crossing point at the same time the car is speeding.
The key point is that pedestrians are not automatically the victims in these situations. Causing an accident as a pedestrian can carry real consequences. If someone crosses improperly and causes harm to another person, they can be exposed to a fine, and depending on the circumstances, even a prison sentence.
